The same commitment to clarity and follow-through that defines our service on-site governs how we work together on paper. Please read these terms before requesting a quote or scheduling service.
01Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of drycare.com (the "Site") and any dry carpet cleaning services provided by DryCare LLC ("DryCare," "we," "us," or "our"). By accessing the Site, submitting a quote request, or engaging DryCare for services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.
Where a separate signed service agreement, purchase order, or government contract governs a specific engagement, the terms of that document will control to the extent they conflict with these Terms.
02Description of Services
DryCare provides proprietary dry carpet cleaning, encapsulation cleaning, and related maintenance services to commercial facilities, government buildings, and multi-floor offices, along with informational content, an online cost estimator, and quote request tools available through the Site. Service scope, frequency, and pricing for any specific engagement are defined in the applicable quote, proposal, or contract, not by general descriptions on the Site.
03Quotes, Estimates & Pricing
Quotes and estimates generated through our online cost estimator or provided informally are good-faith approximations based on the information you supply, including square footage, facility type, and service frequency. They are not binding offers until confirmed in a formal written quote or signed agreement following an on-site or documented assessment.
Published pricing (such as per-square-foot maintenance rates referenced on the Site) is subject to change without notice and may vary by facility condition, access, sector, and contract terms. Government and multi-year contract pricing is governed by the applicable procurement agreement.
04Scheduling & Service Delivery
Service dates and times are scheduled by mutual agreement and confirmed in writing or through our scheduling system. You are responsible for providing DryCare with safe, reasonable access to the facility, accurate facility information, and advance notice of any conditions (security clearance requirements, after-hours access, hazardous materials, etc.) that may affect service delivery.
DryCare documents each completed service visit, including work performed, location, and outcome, consistent with our standard of accountability.
05Payment Terms
Unless otherwise specified in a signed agreement or purchase order, invoices are due upon the terms stated on the invoice. Late payments may be subject to a late fee and, at DryCare's discretion, suspension of scheduled services until the account is brought current. Government and contract customers are billed according to the payment terms of their governing procurement agreement.
06Cancellations & Rescheduling
We ask for as much advance notice as possible if you need to cancel or reschedule a service visit. Cancellations made with insufficient notice may be subject to a trip or rescheduling fee, as disclosed in your quote or service agreement. DryCare reserves the right to reschedule service due to weather, safety conditions, or circumstances outside our reasonable control, and will make prompt efforts to notify you and arrange an alternative date.
07Warranties & Disclaimers
DryCare performs services using its proprietary dry cleaning process and trained technicians, consistent with the standards described on this Site. Any specific service guarantee (such as spot-return guarantees) applies only as stated in your written quote or service agreement.
Except as expressly stated in a signed agreement, the Site and its content are provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Results can vary based on carpet age, fiber type, existing damage, and prior treatment history, and DryCare makes no guarantee that every stain or condition can be fully resolved.
Pre-Existing Conditions
DryCare is not responsible for pre-existing damage, wear, discoloration, or conditions in carpet, flooring, or furnishings that exist prior to service, or for conditions that are inherent to the age or manufacture of the carpet, and which our process cannot reasonably be expected to correct.
08Limitation of Liability
To the fullest extent permitted by law, DryCare's total liability for any claim arising from or related to our services or this Site — whether in contract, tort, or otherwise — is limited to the amount you paid DryCare for the specific service giving rise to the claim. In no event will DryCare be liable for indirect, incidental, special, consequential, or punitive damages, including lost business or lost profits, even if advised of the possibility of such damages.
Nothing in these Terms limits liability that cannot be limited under applicable law, and nothing here is intended to override the terms of a specific government contract where such contract terms are required to control.
09Website Use & Intellectual Property
All content on the Site — including text, graphics, logos, the DryCare name, process descriptions, and the layout and design of the Site — is the property of DryCare or its licensors and is protected by intellectual property laws. You may view and use the Site for your own informational purposes related to evaluating or engaging DryCare's services, but you may not copy, reproduce, distribute, or create derivative works from the Site's content without our prior written consent.
You agree not to use the Site to submit false information, attempt to gain unauthorized access to our systems, interfere with the Site's operation, or use any automated means to scrape or extract content from the Site.
10Indemnification
You agree to indemnify and hold DryCare, its officers, employees, and subcontractors harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site, your breach of these Terms, or inaccurate information you provide in connection with a quote or service request.
11Governing Law
These Terms are governed by the laws of the state in which DryCare LLC is organized, without regard to conflict-of-law principles, except where a specific government or commercial contract designates a different governing jurisdiction for that engagement. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the courts located in that state, unless otherwise required by a governing contract.
12Changes to These Terms
We may revise these Terms from time to time. When we do, we will update the "Effective Date" above. Continued use of the Site or continued engagement of our services after changes take effect constitutes acceptance of the revised Terms. Material changes affecting an active signed service agreement will be handled according to the amendment provisions of that agreement.
